Copyright is the exclusive right given to the owner of a copyright for a specific period. Copyright protection in Malaysia is governed by the Copyright Act 1987.
It is easy to have a copyright since the author do not have to register it. It is automatically copyrighted after the author completed all elements for copyright are completed. There are - 
                  1]   Being eligible work
                  2]   Originality
                  3]   Material form

However, being copyrighted is not good enough IF the owner of the copyright does not know how to control it. Here are those exclusive rights for the owner to control:



  •       the reproduction of the works in any form (including photocopying,    recording etc);
  •       the performing, showing or playing to the public;
  •       the communication to the public;
  •       the distribution of copies to the public by sale or other transfer of ownership; and
  •       the commercial rental to the public.

Are you one of the social networking member? I'm pretty sure that most of people out there have at least one account for Facebook, Friendster, MySpace or even any Instant Message account. Those things are much enjoyable while you can make friends anywhere all over the world. Communicating with people around the world is no more troublesome when social network has existed. While having fun connecting with people, you should have know that you actually can destroy your privacy too. Therefore, we should 'play the game' wisely. Simple steps to enjoy social networking and no destroy your privacy to be shared here:

  • Beware of pretender and be vigilant. Potential exploiters can pretend to be someone else with a different background and convince you to add them as your friend.
  • Never share or post your personal information such as hand phone number, home or work address in your profile. Exploiters use these files to search for victims.
  • Be careful when posting text and image as it can be copied out by potential exploiters. Think before posting your photos as exploiters can use it to blackmail or threaten you. Personal photos should not have revealing information such as you location.
  • Add people as friends to your site only if you know them in person.Do not meet someone whom you have 'first met' on a social networking site.
  • Do not respond to harassing or threatening comments posted on your profile.
  • Never share your password.

Something to share with all of you today...
It is good to hear that Malaysia has found new alternative to fight against piracy. Recently, Malaysia has used two sniffer dogs to hunt for discs of illegal recordings. The name of the sniffer dogs are Lucky and Flo. It makes Malaysia the first country in the world to use dogs as a deployment to detect discs in hidden compartments. Lucky and Flo can sniff out CDs and DVDs,including burned or replicated discs. However, they cannot differentiate between legitimate and pirate discs. This issue proved that Malaysia has moved a step forward in piracy fight. It was a positive move as people still thinking about initiatives of this problem and concern about it.

Privacy Right is basically the state where a person is not watched or disturbed by other people or anything. People needs a privacy protection where ever there are. We can say that every country in the world has a privacy protection for the people; but how protected the people is the question that always came up in our minds. Do you know that Malaysia has a poor Privacy Protection? Some of you might be surprised, but that is the truth when it is proved by the Privacy International. 
In the International Privacy Ranking released on 28 December last year, Malaysia shared the last spot with China and Russia and categorized as “endemic surveillance societies”. In my perspective, the poor ranking for Malaysia might be due to the rights given to police in order to search and investigate some particular cases without a warrant. However, the installation of closed-circuit television (CCTV) in many places also one of the factor which made individuals or societies has no privacy. Although the use of CCTV is aimed to reduce crimes in Malaysia, but up till now crimes are never reduced but it is increasing. In other words, the use of CCTV is not really effective in Malaysia.
On the other hand, the capabilities of MyKad to hold personal details and bank information is another factor we are loosing our privacy.
Lets view the three components of Privacy Right which might help us to understand more about this issue:


  • SECRECY - Information known about individual
  • ANONYMITY - Attention paid to an individual
  • SOLITUDE - Physical access to an individual

Online banking is the most easier and more convenience way for people today. Either we want to do transaction, to check our account status, prepaid reload or even paying bills; all those things can be done in front of your computer. However, this technology somehow can harm the users themselves. Cybercrime is the one of the reason we should afraid of if we do not follow the safe steps when going online. we can lose our money in just one minute. These are the simple steps for online banking user to avoid from being a victim of cybercrime.





  • Keep your password/PIN code safe and memorize them. Make sure you change them regularly (at least every 3 months). If you conduct transactions in a number of websites, use different passwords for each. Create unique passwords that are difficult to guess, e.g. use combination of letters and numbers. 
  • How do you know the website is secured?
  • Look for https:// in the URL and not http:// when you login.
  • Look at the status bar for the security icon (locked padlock) when you visit the bank site. Ensure the icon is within the browser frame.
  • Do not respond to emails asking for personal information, login information or change password notification. If you are not sure of the sender, contact your bank.
  • If you decide to go to other websites linked via your internet banking website, read the privacy and policy information of that website first before conducting any online transactions.

Do you actually read the Privacy Policy of the company which you are dealing with? For example, when you book online ticket or when you do online transaction in a online banking system? I'm sure a lot of people are tend to forget about this part and very lazy to read. Some people even did not know where the PRIVACY POLICY of that company can be reached. Actually, the Privacy Policy can be found at the bottom of the homepage for that particular website. Privacy Policy contains a lot of information telling customers the purpose of collecting the personal data, what type of information do they collect from us and the disclosure of that information.

Privacy Policy is very important for customers or clients to know and here are the steps to determined the privacy policy of the company we are dealing with; in order to discover how protected we are and how far the company can go with our personal information:

  1. The personal data shall be collected fairly and lawful
  2. Purpose of collection of personal data
  3. Use of personal data
  4. Disclosure of personal data
  5. Accuracy of personal data
  6. Duration of retention of personal data
  7. Access to and correction of personal data
  8. Security of personal data
  9. Information to be generally available

As time goes by, I learned more and more about law. Sometimes, it makes me surprise of the new things I learned and a lot of questions came out from my mind. One of the things that makes me wonder and curious about is, what happen to our details given to a particular company or online communities after we send it? The best part is if they do not want the details anymore, will they just throw it? or SELL it? Are they REALLY THROW it until no one can found those details or just simply move it to bin???hurmmm...so much question marks,huh?:P
well, up till now, I still don't really know all the answers for those question. In the very basic stage, we only understand that our details will be used for a certain purposes and if they don't want our details anymore, they will throw it. However, those are the things that we can think of. We do not know what actually happen inside this situation. In law, we as a consumer has a full right for not to disclosed every single details that we do not want people to know it. As my own experience, I used to fill up forms by filling all those information required as I taught that I must give my details to them as required. Now I learned that we actually have a full right to protect our personal details by not giving them every details.
Therefore, in order to be safe and protected, we should limit our details to be disclose which might be misused by other party.


Here are some of the guidelines to protect your personal details when you are online:


1] Don't post information that you are not comfortable sharing with strangers.


2] Stay aware of how such information might be used by scammers of all kinds, both online and off, and avoid from sharing too much


3] Avoid passwords that could easily be guessed - your name, family's name, etc...


4] Don’t give out any more information than what is truly necessary
